The Oath Comes After the Choice: What the Odisha Governor's Remark Reveals About the Silence in Article 155

Braj Mohan Ram says he was denied a party ticket three times and stayed loyal anyway. A day after being named Governor of Odisha, he thanked his party's top leaders for remembering a grassroots worker and spoke of building his party's vote in the State he will now head as a neutral constitutional authority.

Summary

Former Jharkhand BJP MP Braj Mohan Ram was appointed Governor of Odisha on 12 October 2026. The next day he told PTI he would work to activate the BJP's Scheduled Caste morcha in Odisha and bring the party more votes. The BJD and the Congress said the remark violated the neutrality expected of a Governor.

Ram later said, as reported, that he was now above party politics. The episode exposes a structural gap: the Constitution polices a Governor's conduct through the Article 159 oath but sets almost no rule on whom the Union may choose.

WHY IT MATTERS FOR UPSC & STATE PCS

President Droupadi Murmu appointed Braj Mohan Ram, a Dalit leader and former BJP MP from Jharkhand, as Odisha's 28th Governor through a communiqué dated 12 October 2026. Speaking to PTI in Ranchi on 13 October, he said he would assess the situation in Odisha, activate the BJP's SC morcha there and work for more votes for the party.

On 14 October, BJD spokesperson Lenin Mohanty condemned the remark as negating the principle that a Governor stands above party politics. Ram is due to take the oath on 18 October.

Standard News

AN OATH CANNOT DO THE WORK OF AN APPOINTMENT RULE

The Constitution says remarkably little about who may become a Governor. Article 155 says only that the President appoints the Governor and in practice the President acts on the advice of the Union Cabinet. Article 157 asks for just two things: Indian citizenship and a minimum age of 35. Article 156 adds that the Governor holds office at the President's pleasure.

Everything else about neutrality is meant to be supplied later, by Article 159, the oath to preserve, protect and defend the Constitution and the law. Braj Mohan Ram's remark matters because it shows what fills that silence.

The rule as written The text regulates the Governor after the choice is made, not the choice itself.

The oath is the main constitutional instrument meant to turn an appointee into a neutral head of State. The Supreme Court has repeatedly underlined that this neutrality is the point of the office:

  • In B.P. Singhal (2010), it held that a Governor is not an employee or agent of the Union government.
  • In Nabam Rebia (2016), it called the Governor a constitutional sentinel rather than the Centre's representative.

The rule as practised Speaking to PTI in Ranchi a day after his appointment, Ram said he would activate his party's Scheduled Caste morcha in Odisha and work for more votes.

He thanked the Prime Minister and the Home Minister for picking a grassroots worker like him. He recalled that he had been denied a ticket three times and stayed loyal regardless. This was not a slip of the tongue so much as a frank description of how the appointment was understood: as a reward for loyalty.

His clarification on 15 October that he was now above party politics, as reported, does not change what the first statement disclosed.

What the

Commissions saw coming The Sarkaria Commission (1988) recommended that a Governor be an eminent person from outside the State, not closely connected with its politics. The Punchhi Commission (2010) went further and advised that active politicians should not be appointed without an adequate cooling-off period.

Neither recommendation was ever turned into binding law. That is why an appointment can travel straight from party work to Raj Bhavan.

Where appointment criteria are absent, the oath must carry the whole weight of neutrality and an oath is only as strong as the appointee's own restraint.

Why restraint alone is fragile The 2019 Kalyan Singh episode tests this point.

The then Rajasthan Governor publicly backed a party's re-election and the Election Commission found he had breached the Model Code of Conduct and forwarded its findings to the President. The safeguard worked only after the fact and only through a body outside the constitutional design of the office.

Why this matters The exam lesson is architectural.

The Constitution governs a Governor's conduct but not their selection. Until selection is governed too, by a cooling-off rule or consultation norms, the office's neutrality will keep depending on individual temperament rather than on structure.
