Why "We Followed a Different Law" Isn't a Full Answer The CAPFs (General Administration) Act, 2026 is, on

its face, a legitimate legislative act - Parliament can pass laws and a new statute is not automatically void just because it changes the practical effect of an earlier court judgment. That's the executive's real argument and it isn't frivolous.

But Article 141 makes Supreme Court judgments binding as law across the country and a directive judgment addressing a specific service-fairness problem - CAPF cadre officers stuck without leadership pathways because IPS officers occupy the top ranks - doesn't stop binding the executive simply because a new statute reframes the same practice as policy.

The question a court asks next isn't "was this technically legal to pass" but "was this legislation a genuine policy reconsideration or a targeted workaround of a specific order this same government had just lost."

What Each Side Actually Stands to Lose If the

executive's discretion wins here, CAPFs keep drawing on broader policing experience through IPS deputation - a real operational value the government isn't wrong to want. But CAPF cadre officers, who spend decades building specialised border-guarding and internal-security expertise, continue facing the exact career stagnation the 2025 judgment was written to fix and a "strong lobby," as Justice Bhuyan put it, keeps shaping outcomes regardless of what the Court ordered.

If the judgment's spirit wins instead, cadre officers get the leadership pathway they were promised, but the executive loses a genuine argument about specialised versus generalist expertise in security leadership - and that loss is not obviously wrong to resist, either.

Why This Case Matters Beyond CAPFs

The exam-relevant insight isn't "the government defied the Supreme Court"

• it hasn't, technically; it's litigating this through legislation and affidavits, which is itself telling. The deeper lesson is that Article 141 compliance can be undermined without open defiance, simply by relegislating around a judgment's substance while preserving procedural correctness. That distinction - between the form of compliance and its actual effect - is exactly what the Court's demand for an affidavit on "procedure followed" is now testing.
